βCan I fly with it broken?β β The flow every pilot must know

If something in your aircraft isnβt working, you need to determine if itβs required or optional before you can legally fly. Β§91.213 gives you a step-by-step flow to answer that question. Just saying βitβs not importantβ isnβt good enough β you have to walk through the logic.

Step-by-Step Flow: βCan I fly with [X] inop?β
Letβs use autopilot as the example:
β Itβs not working β can I still go fly?
π STEP 1: Is it required by an Airworthiness Directive (AD)?
β If YES β β You cannot fly until itβs fixed (ADs are mandatory)
β If NO β continue
π STEP 2: Is it required by the Type Certificate Data Sheet (TCDS)?
Some equipment is mandatory for that aircraftβs certification
β If YES β β No go
β If NO β continue
π STEP 3: Is it required by Β§91.205 (A TOMATO FLAMES / FLAPS / GRABCARD)?
Check if the item is part of the required equipment list for the type of flight (VFR Day/Night or IFR)
β If YES β β No go
β If NO β continue
π STEP 4: Is it required by the KOEL (Kind of Operations Equipment List) or an MEL?
KOEL = built into the POH/AFM for aircraft like the DA40
MEL = a specific, FAA-approved list (rare in training aircraft)
β If YES β β No go
β If NO β now you can move forward
β
If Itβs NOT Required by Any of the Aboveβ¦
You may operate the aircraft if all three of the following are done:
β The equipment is deactivated or removed
β Itβs placarded "INOPERATIVE"
β The PIC determines it wonβt affect safe operation
β If deactivation/removal requires maintenance, it must be logged properly
βοΈ Scenario:
Your autopilot in the DA40-180 is inop.
You:
β Check the ADs β no AD requiring it βοΈ
β Check the TCDS β not required βοΈ
β Check Β§91.205 β autopilot not listed βοΈ
β Check the KOEL β not required for VFR βοΈ
β Placard it "INOPERATIVE"
β Ensure safe operation / deactivate equipment
β Log any maintenance, if required
π Youβre good to fly VFR without the autopilot.
